This Anti-Spam Policy applies to all customers, users, affiliates, resellers, contractors, and third parties who use or promote services provided by eXDigital LLC (“eXDigital”, “we”, “us”, or “our”).

We do not allow spam, unsolicited bulk email, abusive messaging, deceptive marketing, or any activity that damages our network, domains, IP addresses, sender reputation, services, suppliers, or customers.

By using our services, you agree to this Anti-Spam Policy and our Terms of Service.

1. No Spam

You must not use eXDigital services to send, facilitate, host, relay, promote, or support spam.

This includes using our servers, IP addresses, email accounts, SMTP services, websites, forms, scripts, DNS, domains, hosting accounts, reseller accounts, or any other service connected with eXDigital.

2. Definition of Spam

Spam includes any unsolicited, unwanted, deceptive, or abusive electronic message, especially when sent in bulk or for commercial purposes.

Spam may include email, contact form messages, SMS, instant messages, social media messages, push notifications, comments, forum posts, or similar communications.

A message may be considered spam if:

  1. The recipient did not give valid permission to receive it.

  2. The sender has no existing business relationship with the recipient.

  3. The recipient previously opted out.

  4. The message is sent to a purchased, rented, scraped, harvested, guessed, or third-party list.

  5. The message uses misleading sender details, routing information, subject lines, links, branding, or content.

  6. The message hides or misrepresents the sender’s identity.

  7. The message does not provide a clear way to unsubscribe where required.

  8. The message continues after the recipient has opted out.

  9. The message promotes illegal, deceptive, abusive, or prohibited content.

  10. The message causes blacklisting, complaints, or harm to eXDigital’s network or reputation.

3. Permission-Based Email Only

You may only send marketing or bulk email to recipients who have given valid permission to receive messages from you, or where you have another lawful basis to contact them.

You must be able to prove how and when each recipient joined your list.

Acceptable permission may include:

  1. A user completing an opt-in form.

  2. A customer requesting information from you.

  3. A customer agreeing to receive marketing during checkout or signup.

  4. Another clear and lawful permission method.

The burden of proving consent or permission is on you.

4. Purchased, Rented, Scraped, or Harvested Lists

You must not use purchased, rented, borrowed, scraped, harvested, appended, or third-party email lists with eXDigital services.

You must not collect addresses from websites, directories, forums, social networks, public records, WHOIS records, data breaches, or other online sources for bulk messaging.

5. Email Content Requirements

All commercial email sent using or connected with eXDigital services must:

  1. Use accurate “From”, “To”, “Reply-To”, routing, and header information.

  2. Use a subject line that is not false or misleading.

  3. Clearly identify the sender.

  4. Include a valid physical postal address where required by law.

  5. Include a clear and working unsubscribe method where required.

  6. Honour opt-out requests promptly.

  7. Avoid deceptive links, cloaking, impersonation, phishing, malware, or misleading claims.

  8. Comply with all applicable email, privacy, consumer protection, and advertising laws.

6. Unsubscribe Requirements

Marketing emails must include a simple way for recipients to opt out.

You must honour opt-out requests as soon as reasonably possible and within the time required by law.

You must not charge a fee, require unnecessary information, force account login, or make the unsubscribe process difficult.

Once a recipient opts out, you must not send them further marketing messages unless they later give valid renewed permission.

7. Affiliate, Reseller, and Third-Party Marketing

You are responsible for the actions of any affiliate, reseller, contractor, agency, marketer, lead generator, or third party acting on your behalf.

You must not allow third parties to promote your website, business, products, or services using spam.

If spam is sent by an affiliate or third party promoting your website, domain, brand, or service, we may treat it as a violation of this policy.

8. Mailing List Management

If you operate a mailing list using our services, you must:

  1. Use confirmed opt-in where appropriate.

  2. Keep accurate consent records.

  3. Remove bounced, invalid, inactive, or complaining addresses.

  4. Process unsubscribes quickly.

  5. Monitor complaint rates.

  6. Avoid sending to role accounts where inappropriate, such as abuse@, admin@, support@, postmaster@, or info@.

  7. Secure mailing scripts, forms, plugins, and SMTP credentials.

  8. Prevent unauthorised use of your account to send spam.

9. Prohibited Email Activity

You must not use eXDigital services for:

  1. Unsolicited bulk email.

  2. Phishing or credential theft.

  3. Malware, ransomware, spyware, or harmful attachments.

  4. Fake invoices, scams, or deceptive promotions.

  5. Spoofing or impersonation.

  6. Snowshoe spam.

  7. Open mail relays.

  8. Email bombing or mail flooding.

  9. List washing or suppression list abuse.

  10. Sending through compromised accounts.

  11. Using our network to host landing pages for spam sent elsewhere.

  12. Redirecting spam traffic to websites hosted with us.

  13. Promoting websites, products, or services using spam, even if the email is sent through another provider.

10. Website Forms and Scripts

You are responsible for securing website forms, contact forms, newsletter forms, comment forms, scripts, plugins, and applications hosted on your account.

If an insecure form or script is abused to send spam, we may suspend the account or disable the script.

You should use CAPTCHA, rate limiting, validation, authentication, and secure plugin practices where appropriate.

11. Abuse Complaints

We investigate spam and abuse complaints.

If we receive complaints involving your account, domain, IP address, website, email, or service, we may ask you to provide evidence of permission, list source, email content, sending logs, opt-in records, and unsubscribe handling.

Failure to cooperate may result in suspension or termination.

12. Blacklisting and Reputation Damage

If your activity causes eXDigital IP addresses, domains, servers, mail systems, or suppliers to be blacklisted, rate-limited, blocked, or reputation-damaged, we may suspend or terminate your services immediately.

You may be responsible for any cleanup, delisting, administrative, supplier, or recovery costs caused by your activity.

13. Enforcement

If we determine that this policy has been violated, we may take one or more of the following actions:

  1. Issue a warning.

  2. Require proof of consent.

  3. Require list cleanup.

  4. Disable email sending.

  5. Disable scripts or forms.

  6. Suspend the affected service.

  7. Terminate the account.

  8. Remove or disable hosted content.

  9. Block ports, IPs, domains, or traffic.

  10. Report activity to upstream providers, registrars, law enforcement, regulators, or affected third parties.

  11. Refuse future service.

We may act immediately, without advance notice, where necessary to protect our network, customers, suppliers, reputation, or legal position.

14. No Refunds for Spam Violations

If your service is suspended or terminated for spam, abuse, fraud, deceptive marketing, or violation of this policy, you are not entitled to a refund.

Outstanding fees remain payable.

15. Reporting Spam

If you believe eXDigital services have been used to send spam or support abusive email activity, contact us at:

Please include as much detail as possible, such as:

  1. Full email headers.

  2. The message body.

  3. Date and time received.

  4. Sender address.

  5. Recipient address.

  6. Links included in the message.

  7. Any relevant screenshots or logs.

16. Changes to This Policy

We may update this Anti-Spam Policy at any time by posting a revised version on our website.

Your continued use of our services after an update means you accept the updated policy.
